Thomas Eiler is an associate attorney at Zipin, Amster & Greenberg, LLC, specializing in unique areas of employment law. Over multiple years of practice, Mr. Eiler has cultivated a grounded perspective in both wage and hour matters and employee mobility matters. On the one hand, Mr. Eiler zealously prosecutes cases related to unpaid wages for individuals and classes of employees, including wages determined to be prevailing under the federal Davis-Bacon Act and the Service Contract Act. Mr. Eiler has been certified as class counsel multiple times to protect the rights and interests of absent class members in wage and hour matters, including in Castillo de Martinez, et al. v. Tier-One Property Services, LLC, et al., Case No. 23-2339-LLA (D.D.C.) and Jackson, et al. v. Eagle Academy Public Charter School, Case No. 2024-CAB-005266 (D.C. Sup. Ct.). Additionally, he defends employees where employers seek to enforce signed contracts with noncompetition, nonsolicitation, and confidentiality clauses. Mr. Eiler also defends employees for alleged trade secret theft under various state laws and the federal Defend Trade Secrets Act. In Blakeman, et al. v. Geneva Enterprises, LLC, et al. (AAA Arb. No. 01-22-0000-1610), Mr. Eiler, as part of a team of lawyers, dismantled the employer’s counterclaims, including claims under the Virginia Uniform Trade Secrets Act, and secured a finding that those claims were filed in bad faith against the named plaintiff in a collective wage action. Mr. Eiler also assists employees seeking back pay and other benefits when they are improperly misclassified by their employers as independent contractors.

On the other hand, Mr. Eiler represents companies in situations where their valuable proprietary and confidential information has been stolen, or former employees violate clear contractual agreements. In Streamline Management, LLC, et al. v. At Home Property Management, LLC, et al., Case No. C-15-CV-24-002863 (Montgomery Cnty. Cir. Ct.), Mr. Eiler secured a preliminary injunction enjoining a departing employee who took client lists from servicing the clients on that list even though that employee had never signed a restrictive covenant agreement. Mr. Eiler provides tireless advice and counseling to employers seeking to better understand the needs of employees and draft common-sense policies and practices for growing businesses of all kinds. Mr. Eiler understands the distinct risks of litigation, not only from a practical perspective, but from years championing the rights of employees where employers stepped over the line into illegal territory.

Mr. Eiler is licensed in the District of Columbia and Maryland as well as their respective United States District Courts at the federal level. Mr. Eiler is a member of the Bar for the Fourth Circuit Court of Appeals and the Court of Appeals for the District of Columbia.

Mr. Eiler is a member of the Metropolitan Washington Employment Lawyers Association, the District of Columbia Bar Association, and the Maryland State Bar Association. Mr. Eiler is also an alumnus of the American University Washington College of Law. While at Washington College of Law, Mr. Eiler was a junior and senior staffer on the International Law Review and defended criminal actions as a member of the Criminal Justice Clinic. Mr. Eiler received his undergraduate degree from Washington State University.
